Terms

1. General

By placing an order on this website you are agreeing to the terms and return policy of the Onlineshop (http://www.wearbaeis.ch) of Bæis (hereafter: Bæis) and the customer (hereafter: you) as well as on all orders  (by phone, e-mail or in persona) for which Bæis declares the GTC as applicable.

If you wish to place orders for commercial requirements you should contact us by e-mail hello@wearbaeis.com.

 

2. Establishment of Contract

A sales contract enters into force through your offer and the subsequent order receipt issued by Bæis and is thereafter binding for you. With the submission of your order you confirm your agreement on the content and scope of your order.

Any issues arising shall be clarified by Bæis beforehand.

If, after formation of the contract, we find that we are unable to complete an order due to reasons beyond our control (e.g. any case of Act of God), we are entitled to withdraw from the agreement. In any event, we will notify you if we are unable to complete an order. If this occurs, any payments already made will naturally be reimbursed to you.

 

3. Product Offer

All information provided by Bæis on goods and prices during the ordering and processing are non-binding and subject to confirmation.

In particular, any changes regarding the design and technique which enhance the functionality of the good, as well as error in specification, illustration and pricing are reserved.

Bæis endeavours to depict the products, especially the designs, sizes and colours, truthfully. However, Bæis must point out that due to colour settings minimal color deviation may result and do not constitute a defect of the product.

4. Prices

All prices are set in Euros (EUR) and are subject to unannounced change at any time without annotations. The effective cost of shipping are shown in the cart prior to ordering. The prices shown on the Website at the time of ordering are applicable.

 

5. Terms of Payment

The following payment methods are provided:

- Credit card payments with Stripe

- PayPal payments with PayPal Express

 

6. Conditions of Sale

Most of our orders are shipped within 2 business days of purchase, pending availability and credit verification.

Possible value added tax, customs duties and customs clearance duties shall be borne by you as the buyer.

The rules and regulations for import fees vary from country to country and state to state, so please contact your customs office for further details.

 

7. Retention of Title

Bæis retains title of ownership of the delivered products until the purchase price has been paid in full.

Risk of damage or loss regarding the products ordered will pass on to the buyer at the time of the hand-over to the shipping partner. Bæis reserves the right to register an appropriate entry in the retention of title register. If you are in default with regard to the payment of the purchase price Bæis is entitled to withdraw from the contract (rescission notice) and to reclaim the products.

 

8. Right of Return / Revocation

    8.1 General Regulations

    Purchases may be returned within 14 days. Please ensure that items are unworn, unwashed, undamaged and include all tags the item came with to the following address:

    It's advised to make sure your return package is trackable. Without a tracking number we cannot guarantee a safe arrival of your return.

    The products shall be considered delivered on the date of delivery more specifically the first attempted delivery.

    Before returning the goods you need to contact Bæis (hello@wearbaeis.com) and inform us about the reason of the return.

    The costs involved and the risk of the return are always borne by the buyer. The decision to replace a product is at our discretion

    Once received the item we expect the return payment to take around 2 - 3 weeks. International exchanges may take longer. We’ll let you know once your item is received and your refund has been processed using the same payment method.

     

    9. Privacy Policy

    Bæis commits to protect your personal data and to process customer data with care and strictly confidential as well as to follow relevant data protection policies. Bæis does not pass your details on to third parties, in particular, your details are not sold, hired out or exchanged. Hereof excluded are any external services (i.e. dispatching the order) provided by partners which require the data for logistical purposes.

    In principle it is not possible to assume liability for the safety of data transmitted in the internet.

    Bæis may use the information collected from you for marketing purposes, provided you have given your consent to such utilization. Additionally, you will receive our newsletter if you have signed up for it.  Cancellation of the subscription is possible at any time given.

     

    9.1 Google Analytics

    This website uses Google Analytics, a web analytics service provided by Google, Inc. (“Google”).  Google Analytics uses “cookies”, which are text files placed on your computer, to help the website analyze how users use the site. The information generated by the cookie about your use of the website (including your IP address) will be transmitted to and stored by Google on servers in the United States. Google will use this information for the purpose of evaluating your use of the website, compiling reports on website activity for website operators and providing other services relating to website activity and internet usage. Google may also transfer this information to third parties where required to do so by law, or where such third parties process the information on Google's behalf. Google will not associate your IP address with any other data held by Google.     9.2 Facebook

    This website uses social plugins (“plugins”) from the social network facebook.com which is operated by Facebook Inc., 1601 S. California Ave, Palo Alto, CA 94304, USA (“Facebook”). The plugins are identified by one of the Facebook logos (white “f” on blue tile or a “thumbs-up” sign).     If you call up one of our internet website pages which has a plugin of this kind, your browser sets up a direct link to the Facebook servers. The content of the plugin is passed by Facebook direct to your browser and integrated by it into the website. This means that we have no influence over the extent of the data which Facebook obtains with the help of this plugin and we therefore inform you according to our information status:

    Through integration of the plugin, Facebook obtains the information that you have called up the relevant page on our internet site. If you are logged on to Facebook, Facebook can allocate the visit to your Facebook account.     10. Court of Jurisdiction and Applicable Law

    All legal relationships between Bæis any you shall be ruled in accordance with Portuguese law alone, with the complete exclusion of the United Nations Convention on Contracts for the International Sale Goods, 11 April 1980 (Vienna Convention). The sole place of jurisdiction for any disputes arising from these General Terms and Conditions shall be the Portuguese domicile of the Company.

    11. Severability Clause

    In the event any provision or part of these GTC is found to be invalid or unenforceable, only that particular provision or part so found, and not the entire GTC, will be inoperative.

    Instead of any ineffective, void or impracticable regulation or to complete a gap the legally effective regulation shall be replaced by an appropriate arrangement that comes as close as possible to the intention of the parties.

     

    12. Final Provisions

    These GTC apply and are valid upon the conclusion of the contract with the sales of the goods specified in the Bæis online shop at that point in time of the current conclusion of the contract. These conditions are valid even if they should differ from those of the customer. In all other aspects Bæis reserves the right for changes to these general regulations.
